Terms & Conditions

Please carefully read the following terms and conditions relating to use of the www.nutracheck.co.uk and www.nutracheck.com Websites and App (the "Service"). By using the Service you agree to these terms and conditions of use. We reserve the right, to change, modify, add or remove portions of these terms & Conditions at any time.

The Service is owned and operated by NutraTech Ltd ("Company"), a company registered in the United Kingdom.

1. Nutracheck Website and App Content

  1. To access the content of the Service you must register with a valid email address or sign-in with a pre-existing Nutracheck registered email and password.
  2. Newly registered users may use the Service free of charge for a period of 7 days, after which restrictions will apply. To remove these restrictions, users may purchase a subscription from a range of membership options via the Website or in-App (see below for more details).
  3. With our discretion and without prior notice or liability, we may discontinue, modify or alter any aspect of the Service.
  4. The Service contains information, software, photos, text, graphics, sounds and other materials that are protected by copyrights, database rights, trademarks, trade secrets and/or other proprietary rights. All content is copyrighted under applicable copyright laws, including United States, United Kingdom, Canadian, Australian, Irish and European Union copyright laws (and, if applicable, similar laws in other jurisdictions). All trademarks that appear in the Service are trademarks of their respective owners. Nutracheck is a trade name of NutraTech Ltd.
  5. You may not modify, publish, transmit, distribute, perform, participate in the transfer or sale, create derivative works of, or in any way exploit, any of the content, in whole or in part unless you receive our prior written consent.
  6. The Company reserves the right to vary Service content by country, mobile phone make and model, including (but not limited to) (i) size and extent of product database, (ii) application functionality.

2. Privacy & Security

We are committed to protecting your privacy and security. All personal data that we collect from you will be processed in accordance with our Privacy Policy. You should review our Privacy Policy, which is incorporated into these Terms & Conditions by this reference, and you confirm that when using this Service you consent to your personal data being used and processed in accordance with our Privacy Policy.

3. Health Disclaimers

  1. Nutracheck is intended as a weight management tool to assist users with their personal aspirations. NutraTech Ltd is not a medical organisation and we cannot give you medical advice or diagnosis. Any information contained within the Nutracheck Calorie Counter App should not be construed as advice or diagnosis.
  2. You are advised to seek medical advice before making any changes to your diet or lifestyle with an aim of weight loss. This website and the content provided should not be used by persons under 18, by pregnant or nursing women, or individuals with any type of health condition, except under the direct supervision of a qualified medical professional. The information contained in these articles, and elsewhere on this website, is provided for educational and entertainment purposes only, and is not intended to replace, and does not constitute legal, professional, medical or healthcare advice or diagnosis and may not be used for such purposes.
  3. You should seek the advice of your doctor/physician or other qualified health provider with any questions you may have regarding a medical or wellness condition in determining whether to use or adapt the information or content provided. We make no representations or warranties concerning any treatment, action, application or usage of dietary supplements, medication, preparation or other product or service by any person following the information offered or provided within or through the website. Reliance on any information appearing on a site is strictly at your own risk. Neither we, our affiliates nor any of the officers, directors, owners, employees, agents, representatives and assigns of each will be liable for any direct, indirect, consequential, special, exemplary or other losses or damages that may result including, but not limited to, economic loss, injury, illness or death.
  4. If you are in the United States and think you are having a medical or health emergency, call your health care professional, or 911, immediately.
  5. Weight loss is individual and your personal rate of loss may vary from any case studies shown on this website. Our service advocates a safe rate of weight loss of up to 2lbs (0.92kg) per week.
  6. Before starting any weight reduction plan, you should make sure that you are not underweight (defined as BMI below 18.5).

4. Disclaimers of Warranties

  1. Any product, offering, content and material downloaded or otherwise obtained through the use of the Service is done at your sole risk and you will be solely responsible for any damage to your computer system or mobile device or loss of data that results from the download of any such product, offering, content or material.
  2. You agree to indemnify and hold NutraTech Ltd, its parent company, subsidiaries, affiliates, officers, agents, directors, contractors, licensors and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of or in connection with (i) your use of the Service, and (ii) the breach by you of your representations and warranties set forth herein.
  3. NutraTech Ltd does not guarantee that the Service will be error free and uninterrupted or defects will be corrected. Nutracheck's food database has been compiled from Manufacturers' and Retailers' product data, either on packaging or from data sent to us directly. Whilst every endeavour is made to ensure the accuracy of the data, NutraTech Ltd will not be held accountable for any errors in content, or outcomes resulting from the errors.

5. Limitation of Liability

You understand and agree (to the fullest extent permitted by law) NutraTech Ltd will not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any other damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses), arising out of, or resulting from;

  1. the use or the inability to use the Service
  2. the use of any content or other materials within the Service
  3. the cost of buying substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Nutracheck Website or App
  4. unauthorized access to or alteration of your transmissions or data
  5. in no event shall the total liability of us to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Nutracheck Website or App.

If you are dissatisfied with any portion of the Service, or with any of provision of these Terms & Conditions, your sole and exclusive remedy is to cease using the Nutracheck Website and App.

6. Membership fees, in-App purchases and cancellation

  1. Nutracheck Website (Nutracheck.co.uk & Nutracheck.com)
    1. The Nutracheck website provides newly registered users with a 7 day free trial. After the free trial period expires users may purchase a subscription from the range of membership options to continue to have access to the Service.
    2. Membership options and fees may be reviewed at any time at the discretion of NutraTech Ltd.
    3. Customers in the European Union have the statutory right to withdraw from a membership agreement and seek a membership refund within 7 days after the date of purchase for membership.

      To withdraw from the agreement within the 7 day cooling off period, send an email to customercare@nutracheck.co.uk clearly stating 'Cancel membership', together with your name and registration email address. Alternatively you can contact us on +44 (0)115 969 4660. You will receive an email from WorldPay confirming the refund has been issued. Please note - delivery of emails cannot be guaranteed and is subject to email providers and junk mail settings. We are not responsible for lost emails or delays. If you do not receive a refund confirmation email from WorldPay within 72 hours of cancelling (and have checked any email Spam folders), you are advised contact us at customercare@nutracheck.co.uk or call +44(0)1159 694660 to check receipt of your cancellation request.
    4. After your initial membership term of 2, 3 or 6 months, your membership will be automatically renewed on a monthly basis. The renewal rate is the rate published at the point of purchase and confirmed in your WorldPay FuturePay confirmation email.
    5. Membership is continuous and cannot be put on hold for short durations such as holidays.
    6. It is a member's responsibility to cancel their FuturePay monthly renewal if they no longer wish to be a member. This can be done at any time on the website. Sign in to your online account, click on the 'My Profile' tab and select 'My Diet Account'. Use the 'Cancel my monthly renewal' link at the bottom of the page and follow the steps. You will receive an email from WorldPay confirming the FuturePay Agreement has been cancelled. Please note - delivery of emails cannot be guaranteed and is subject to email providers and junk mail settings. We are not responsible for lost emails or delays. If you do not receive the confirmation email from WorldPay within 72 hours of cancelling (and have checked any email Spam folders), you are advised to email us at customercare@nutracheck.co.uk to check receipt of your cancellation request.

      We recommend you cancel at least 48 hours before the renewal date of your next Membership Month as unfortunately no refunds can be made if you cancel after the renewal date has passed and your next Membership Month has started. In the event that you do not use your account, cancellation will not automatically take place. Your account will continue to be charged until you cancel it.
    7. To close your account completely, send an email to customercare@nutracheck.co.uk clearly stating 'Close Account' - please include your name and registration email address. This will close your account immediately (any remaining membership time will be lost) and any active monthly renewal agreement will be cancelled. Alternatively call us on +44 (0)115 969 4660.
    8. We reserve the right to cancel membership at any time and return any fees paid.
  2. Nutracheck Mobile App
    1. The App provides newly registered users with a 7 day free trial. After the free trial period expires, your membership status will change to a 'Lite' user with daily usage restrictions. You may upgrade your membership at any time by choosing an in-App subscription option or purchasing one online at www.nutracheck.co.uk or www.nutracheck.com. In-App subscription options are available to view in the 'More' section within the App.
    2. In-App memberships are charged through your Apple iTunes account or Google Wallet on Android devices.
    3. Membership options and fees may be reviewed at any time at the discretion of NutraTech Ltd.
    4. Please note our usual refund policy does not apply to purchases made via the App.
    5. Members with an Apple iTunes payment query will need to contact Apple directly. To contact Apple, go to your iTunes account > Purchase History and use the 'Report a Problem' link in the invoice.
    6. Members with a Google Wallet payment query may contact us directly by email at customercare@nutracheck.co.uk or alternatively call us on +44 (0)115 969 4660.

7. Supplementary Charges

  1. If you choose to use the optional mobile App, it is your responsibility to check with your network provider about charges that may arise through use of features requiring data transfer.

    Data transfer charges depend upon the service agreement you have with your network provider. The charge will be reflected on your mobile phone bill if you are a pay monthly customer, or deducted from your 'airtime' if you are a pay as you go customer. Network providers have a range of tariffs for data transfer and we strongly advise you to check what charges will apply to your account before commencing to use any mobile service.
  2. NutraTech cannot be held liable for, and will not pay for any charges that you may incur through use of the optional mobile App

8. Listing of Recipes

  1. NutraTech Ltd will permit you to use the 'Meals & Recipes' area of the Service and 'Swap Recipe' forum board as part of your membership. When you use these areas of the Service you confirm (i) that you own the recipes that you post and (ii) that know you are freely sharing the recipes with other members with no charge. We will list your recipe in those parts of the Nutracheck Site where you place your recipe. You should also store a copy of your recipe yourself other than on the Nutracheck Site.
  2. We reserve the right to remove the recipe forthwith where you breach this Agreement. However our failure to remove a recipe shall not be taken as acquiescence that the recipe is not in beach of this Agreement.

9. Prohibited Recipes

  1. You must not post a recipe
    1. in which a third party owns the copyright or another intellectual property right in the recipe
    2. which contains the confidential information of a third party;
    3. which contains a noxious or illegal substance or other unsafe material;
    4. which contains unsafe working methods or advises people to work in an unsafe manner.
  2. In the event of any breach of this clause 9, we reserve the rights to remove any of your recipes from the Service forthwith and without any obligation to refund any membership fees. Nevertheless any failure by us to remove a recipe shall not be taken as a statement that you have fulfilled the requirements of this clause 9.

10. Interpretation

The headings are for convenience only and shall not be taken into account in the interpretation of these terms and conditions.

11. Changes To These Terms & Conditions

We reserve the right to update or change our Terms and Conditions at any time and you should check these Terms and Conditions periodically. Your continued use of the Service after we post any modifications to the Terms and Conditions on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Terms and Conditions.
